5. The data we collect about you
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
- Business Details includes the company name, address and telephone number. Where you are a sole trader this may be your name or trading name and residential address and telephone number where an alternative address and telephone number for the business has not been given. Where you are a partnership this may be the partnership name and the residential addresses and telephone numbers of the partners where an alternative address and telephone number for the partnership has not been given.
- Due Diligence Details includes identity documents such as copies of passports, driving licences or utility bills to evidence address details.
- Financial and Transaction Data includes bank account, payment card information, details about payments to and from you including payment amount and date, card authorisation number and transaction reference.
- Landlord Registration Data includes name, address, contact telephone number, email address and bank account details.
- Invoices includes customer name, services provided and price of service including VAT and amount of any discounts applied.
- Marketing Preferences includes your preferences in receiving marketing from us and your communication preferences.
- Technical Data includes internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website.
- Tenant Application Data includes name, address (current and covering the past 3 years), email address, contact telephone number, employer name and address, guarantor name and address, details of any relevant benefits received, credit scoring reports, contact details for referees, national insurance number, passport or immigration status (if applicable) and bank account details.
Should a guarantor be required, the same information as above will be required.
Special categories. We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
6. If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

We may collect personal data about you in several ways including through:

You may give us your Business Details, Financial Data, Landlord Application Data, Marketing Preferences and/or Tennant Application Data by filling in forms or by corresponding with us via our website or by phone, email or otherwise. This includes personal data you provide when you:

- telephone or email us with a query;
- subscribe to our newsletter or marketing materials, when we will also collect your Marketing Preferences;
- fill in a Tenant Application Form or Landlord Registration Form;
- correspond with us via social media including Facebook, Instagram, Twitter and LinkedIn (for the purpose of responding to a specific message or request only); or
- provide feedback or complain to us.
- Automated technologies or interactions. As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns. - Third parties or publicly available sources. We will receive personal data about you from various third parties and public sources as set out below:
- Technical Data from the following parties:
(a) analytics providers such as Google based outside the EU; and
(b) search information providers who may be based inside or outside the EU.
- Financial and Transaction Data and credit scoring data from providers of technical, payment and delivery services who may be based inside or outside the EU.
- Business Data and Due Diligence Data from publicly available sources such as Companies House and the Electoral Register based inside the EU.
- Technical Data from the following parties:
- Social Media. Where you interact with our social media pages to raise a question or to make a complaint, we may get in touch via that social media platform to respond to the question or complaint. 8. Purposes for which we will use your personal data
We will use your personal data when the law allows us to. We will use your personal data in the following circumstances:
- Due diligence checks. We may carry out due diligence checks which are necessary for our legitimate interests to make business decisions such as deciding on affordability in relation to a particular property. This data includes Tenant Application Data.
- Marketing. We sometimes carry out direct marketing activities to landlords. Some of this marketing does not involve the use of personal data (for example sending marketing by post to the registered office of a company, or email marketing to an email address which is not associated with a specific individual such as “info@…”). We may also carry our more personalised marketing using personal data such as Business Details and Marketing Preferences as appropriate. We carry out marketing activities for our legitimate interests to identify potential new business customers and to grow and promote our business to existing business customers and prospective business customers. We may also carry out direct marketing activities to you where you have provided your specific consent for us to do this, for example by signing up to our newsletter online or by indicating you wish to receive a follow up in any feedback you give us. When we send marketing by email, we include an unsubscribe link. If you do not wish to receive further marketing from us please let us know by contacting us using the details in the Contact us (https://www.whitakercadre.com/contact) section or by clicking the unsubscribe link at the bottom of one of our emails.
- Requesting a service. Where you request a service from us we will use your personal data to fulfil our contractual obligations to you. This may include Business Details, Financial Data, Invoices, Landlord Registration Data and Tenant Application Data as applicable. We also hold some of this information to comply with our legal obligations, for example holding information about payments received and made for tax purposes.
- Requests, queries and complaints. We use your personal data to respond to your requests, queries and complaints, the data we use to do this includes Business Details, Landlord Registration Data and Tenant Application Data. We do this as it is necessary for us to take these steps prior to entering into a contract with you, in performance of a contract we already have with you or for our legitimate interests to provide our customers or prospective customers with a high level of customer service.
- Technical. As well as any personal data that you may give to us we may collect Technical Data to administer and protect our business and our website (including data analysis, testing, system maintenance, support, reporting and hosting of data). This is necessary for our legitimate interests for running our business, provision of administration and IT services, network security and to prevent fraud.
- Key Monitoring. We collect personal data when you visit our premises to collect or return property keys to ensure the security of our premises, business and let properties. This is necessary for our legitimate interests for running our business and for employee and tenant safety.
Change of purpose
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

We may place information on your computer to allow us to identify you. This is not as sinister as it may sound and the information is often known as “cookies”. Cookies are text files placed on your computer to collect standard internet log information and visitor behaviour information. This information is used to track visitor use of our website and to compile statistical reports on website activity, and in certain circumstances allow our website to perform more effectively for the visitor.

External Third Parties
- Service providers acting as processors based in the UK and the European Union who provide IT and system administration services.
- Professional advisers acting as processors or joint controllers including lawyers, bankers, auditors and insurers based in the UK who provide consultancy, banking, legal, insurance and accounting services.
- Contractors based in the UK acting as processors in the provision of services relating to maintenance and repair of a property.
- Marketing service providers based in the UK acting as processors.
- HM Revenue & Customs, regulators and other authorities based in the UK who require reporting of processing activities in certain circumstances.
Other Third Parties
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
11. Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long will you use my personal data for?
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, tax or reporting requirements. We have set out more detail below about how long we consider it necessary to retain data for certain purposes.
We retain Due Diligence Details for 7 years from when the due diligence checks were carried out. If you continue to be our customer and we still require due diligence information for our legitimate interests we will renew and replace the Due Diligence Details held with up to date information but may retain details of the previous checks for our records.
We retain Landlord Registration Data and Tenant Application Data for 7 years from the date when this was provided to us. This information is secured and access is restricted to ensure these records are not used for any other purposes than those set out above.
We retain bank account details for the length of our relationship with you but do not store credit card details.
In respect of our marketing activities we retain Marketing Preferences for the lifetime of our relationship with you or until you ask us to remove or update this, see your legal rights below for further details. Should you change your Marketing Preferences or exercise any of your legal rights (click here for your legal rights) we may retain limited information on a suppression list in order to ensure that we do not contact you again.
We retain Technical Data for 7 years from the date of creation however this is often anonymised and/or aggregated at an earlier date.
We retain Key Monitoring Data for 7 years from the date of the relevant visit.
We may also retain Business Details for a period of 7 years. For complaints relating to work undertaken by third party contractors, we retain such information for a period of 7 years from the date of the relevant contact.

In some circumstances we will anonymise and/or aggregate your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
14. Your legal rights
Under certain circumstances, you have rights under data protection laws in relation to your personal data.
You have the right to:
Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
- If you want us to establish the data’s accuracy.
- Where our use of the data is unlawful but you do not want us to erase it.
- Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
- You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
